ENROLLED, An Act,

To alter, rearrange, and extend the boundary lines and corporate limits of the City of Atmore in Escambia County.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. The boundary lines and corporate limits of the City of Atmore in Escambia County are altered, rearranged, and extended to include within the corporate limits of the city, in addition to the lands now included, all of the following territory:

BEGIN at the Southeast Corner of Section 28, T-2-N, R-6-E, Escambia County, Alabama; Thence run along the south line of said Section 28, N 89 degrees 49' 46" W, 2655.88 feet, more or less, to a point; Thence run N 00 degrees 15' 17" E, 1887.83 feet, more or less, to a point; Thence run N 89 degrees 56' 49" W, 1687.35 feet, more or less, to a point; Thence run N 89 degrees 32' 42" W, 100.93 feet, more or less, to a point lying on the east right of way of Alabama Highway No. 21; Thence run S 88 degrees 23' 39" W, 152.10 feet, more or less, to a point lying on the west right of way of said Alabama Highway No. 21; Thence run N 89 degrees 52' 29" W, 2334.83 feet, more or less, to a point lying on the east right of way of Escambia County Highway No. 14; Thence run along said east right of way, N 41 degrees 05' 39" W, 419.20 feet, more or less, to a point of right of way change; Thence run S 47 degrees 49' 34" W, 9.87 feet, more or less, to a point; Thence continue along said east right of way, N 38 degrees 25' 46" W, 300.32 feet, more or less, to a point; Thence continue along said east right of way, N 38 degrees 50' 31" W, 214.11 feet, more or less, to a point of intersection of said east right of way of Escambia County Highway No. 14 with the south right of way of Interstate Highway No. 65; Thence leave said east right of way and run along the south right of way of said Interstate Highway No. 65, N 73 degrees 18' 25" E, 3111.39 feet, more or less, to a point; Thence continue along said south right of way, N 81 degrees 23' 32" E, 271.34 feet, more or less, to a point lying at the intersection of said south right of way of Interstate Highway No. 65 with the northwest corner of that certain parcel of land conveyed to Poarch Band of Creek Indians, as recorded in the Office of the Judge of Probate, Escambia County, Alabama, in ROLL 1056 at Frame 313; Thence continue along said south right of way, N 81 degrees 37' 00" E, 82.15 feet, more or less, to a point; Thence continue along said south right of way, N 87 degrees 27' 00" E, 463.87 feet, more or less, to a point of intersection of said south right of way with the west right of way of the aforementioned Alabama Highway No. 21; Thence run N 86 degrees 38' 21" E, 269.80 feet, more or less, to a point lying at the intersection of the east right of way of said Alabama Highway No. 21 with the south right of way of the aforementioned south right of way of Interstate Highway No. 65; Thence run along said south right of way, N 60 degrees 19' 00" E, 722.94 feet, more or less, to a point; Thence run along said south right of way, N 60 degrees 58' 37" E, 334.26 feet, more or less, to a point; Thence continue along said south right of way, N 73 degrees 15' 18" E, 696.03 feet, more or less, to a point of curvature; Thence run along said curve and said south right of way, a chord of N 72 degrees 01' 32" E, 499.89 feet, more or less, to a point; Thence continue along said curve and said right of way, a chord of N 69 degrees 37' 23" E, 499.82 feet, more or less, to a point; Thence continue along said curve and said right of way, a chord of N 67 degrees 06' 58" E, 499.97 feet, more or less, to a point; Thence continue along said curve and said right of way, a chord of N 64 degrees 44' 22" E, 464.31 feet, more or less, to a point lying on the east line of Section 28; Thence leave said south right of way and run along said east section line, S 00 degrees 35' 47" E, 5034.86 feet, more or less, to the Point of Beginning.

Said described property lying and being situated in the Northwest Quarter, the Northeast Quarter, the Southeast Quarter and the Southwest Quarter of Section 28 and in the East Half of Section 29, T-2-N, R-6-E, Escambia County, Alabama, and contains 423.842 Acres, more or less; LESS AND EXCEPT the rights of way of Alabama Highway No. 21.

All that Property lying in Section 28 and in Section 29, T-2-N, R-6-E, Escambia County, Alabama, being bounded on the north by the North Line of Section 28 and Section 29; being bounded on the east by the West Right of Way of Alabama Highway No. 21; being bounded on the south by the North Right of Way of Interstate Highway No. 65; and being bounded on the west by the East Right of Way of Escambia County Road No. 14; and containing 234.8 Acres, more or less.

BEGIN at the intersection of the east line of Section 21 with the north right of way of Interstate Highway No. 65; said point lying in a curve; Thence run along said curve and said north right of way, a chord of S 69 degrees 52' 15" W, 1768.86 feet, more or less, to a point; Thence continue along said north right of way, S 82 degrees 00' 47" W, 838.55 feet, more or less, to a point lying at the southeast corner of that certain parcel of land conveyed to BP Oil, as recorded in the Office of the Judge of Probate, Escambia County, Alabama, in Deed Book 436 at Page 423; Thence continue along said north right of way, S 83 degrees 05' 08" W, 521.35 feet, more or less, to a point lying at the intersection of the north right of way of Interstate Highway No. 65 with the east right of way of Alabama Highway No. 21; Thence run along said east right of way, N 30 degrees 47' 55" E, 308.94 feet, more or less, to a point of right of way change; Thence run N 63 degrees 35' 16" W, 30.26 feet, more or less, to a point; Thence continue along said east right of way, N 30 degrees 56' 23" E, 200.10 feet, more or less, to a point lying at the northwest corner of said BP Oil Property; Thence continue along said east right of way, N 30 degrees 55' 49" E, 439.26 feet, more or less, to a point; Thence continue along said east right of way, N 30 degrees 48' 29" E, 285.83 feet, more or less, to a point lying in a curve; Thence continue along said curve and said east right of way, a chord of N 32 degrees 37' 21" E, 452.04 feet, more or less, to a point; Thence continue along said east right of way, N 33 degrees 41' 41" E, 873.79 feet, more or less, to a point lying in a curve; Thence run along said curve and said east right of way, a chord of N 27 degrees 48' 16" E, 821.26 feet to a point; Thence leave said east right of way and run N 90 degrees 00' E, 874.12 feet, more or less, to a point; Thence run S 00 degrees 00' E, 1404.69 feet, more or less, to a point; Thence run S 87 degrees 36' 26" E, 440.70 feet, more or less, to a point; Thence run S 01 degrees 55' 07" W, 696.21 feet to the Point of Beginning.

Said described property lying and being situated in the Northeast Quarter and the Northwest Quarter of Section 28, and in the East Half of Section 21, T-2-N, R-6-E, Escambia County, Alabama, and contains 109.106 Acres, more or less.

PARCEL NO. 1

Commence at the Northeast Corner of the Southeast Quarter of the Northeast Quarter (NE Cor. of SE 1/4 of NE 1/4) of Section Twenty-seven (27), Township One (1) North, Range Six (6) East, and run West four hundred (400) feet to the point of beginning; thence South four hundred twenty (420) feet; thence West two hundred ten (210) feet; thence North four hundred twenty (420) feet; thence East two hundred ten (210) feet to the point of beginning, said land being in the Southeast Quarter of the Northeast Quarter (SE 1/4 of NE 1/4) of Section Twenty-seven (27), Township One (1) North, Range Six (6) East, and containing two (2) acres.

Commence at the Northeast Corner of the Southeast Quarter of the Northeast Quarter (NE Cor. of SE 1/4 of NE 1/4) of Section Twenty-seven (27), Township One (1) North, Range Six (6) East, and run West four hundred (400) feet; thence South thirteen hundred twenty (1320) feet; thence East four hundred (400) feet; and thence North thirteen hundred twenty (1320) feet to the starting point, containing twelve and one tenth (12.1) acres, more or less.

The East four hundred (400) feet of the Northeast Quarter of the Southeast Quarter (NE 1/4 of SE 1/4) of Section Twenty-seven (27), Township One (1) North, Range Six (6) East, containing twelve and one tenth (12.1) acres, more or less.

Commencing at the Southeast Corner of the Southeast Quarter of the Southeast Quarter (SE Cor. of SE 1/4 of SE 1/4) of Section Twenty-seven (27), Township One (1) North, Range Six (6) East, and running thence West six hundred ten (610) feet; thence North four hundred twenty (420) feet; thence East two hundred ten (210) feet; thence North nine hundred (900) feet; thence East four hundred (400) feet; and thence South thirteen hundred twenty (1320) feet to the point of commencement, being 14.12 acres, more or less.

Begin at the Southwest Corner of the Southeast Quarter (SW Cor. of SE 1/4) of Section Twenty-seven (27), Township One (1) North, Range Six (6) East, and run East Two Thousand Thirty (2030) feet to the West line of the Airport property; thence North Fifty (50) feet; thence West Two Thousand Thirty (2030) feet; and thence South Fifty (50) feet to the starting point. Said land being in the Southeast Quarter (SE 1/4) of Section Twenty-seven (27), Township One (1) North, Range Six (6) East, and containing 2.33 acres, more or less.

Beginning at the Southwest Corner of Section 26, Township 1 North, Range 6 East; thence North 3685.0 feet; thence South 89 degrees 08' East, 671.38 feet to the centerline of the below described easement; thence South 3 degrees 12' East, 1059.6 feet along centerline of said easement to end of said easement; thence West 25.0 feet; thence South 14 degrees 51' East, 1071.0 feet; thence South 1582.0 feet; thence West 980 feet to the point of beginning, containing 72.645 acres, more or less.

ALSO a non-exclusive right-of-way or easement for right of egress and ingress to and from the above described property:

Beginning at the Northwest Corner of the Northwest Quarter of Northwest Quarter of Section 35, Township 1 North, Range 6 East and run South 30 feet to start; thence East 254.1 feet; thence South 600 feet; thence West 254.1 feet; thence North 600 feet to the point of beginning and being 3.5 acres, more or less.

Commencing at a point which is Thirty feet (30') South of the Northeast Corner of the Northeast Quarter of the Northeast Quarter (NE Cor. of NE 1/4 of NE 1/4) of Section 34, Township 1 North, Range 6 East; thence West Seven Hundred Twenty-two and seven-tenths (W 722.7') feet; thence South Twelve Hundred Eighty-six (S 1286') feet; thence East Seven Hundred Twenty-two and seven-tenths (E 722.7') feet; thence North Twelve Hundred Eighty-six (N 1286') feet to the point of beginning and being Twenty-one and thirty-one one-hundredths (21.31) acres, more or less.

Section 2. In accordance with Section 11-42-6(b) of the Code of Alabama 1975, a map showing what territory is proposed to be annexed to the City of Atmore is on file in the office of the Judge of Probate in Escambia County, Alabama, and the map is open to the inspection of the public.

Section 3. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
