1999 REGULAR SESSION SUMMARIES
Act 1999-8, HB73, proposes an amendment to Section 65 of Article IV of the Constitution of Alabama of 1901, to establish the Alabama Education Lottery, the Alabama Education Lottery Corporation, and the Lottery Trust Fund. The proposed amendment dedicates the net proceeds from the lottery to fully fund tuition grants, loans, and scholarships for colleges, universities, and junior, technical, and community colleges, voluntary pre-kindergarten programs, technology in the public schools, and the creation of a reserve fund for shortfalls in these programs with any excess revenue accruing to the Education Trust Fund. The proposed amendment also establishes priorities for the expenditure of lottery proceeds, prohibits lottery proceeds from supplanting or replacing existing education revenues, and authorizes the Legislature to pass laws to implement the proposed amendment.

Act 1999-90, HB145, continues the existence and functioning of the Polygraph Examiners Board pursuant to the Alabama Sunset Law.

Act 1999-91, HB149, continues the existence and functioning of the Board of Examiners of Landscape Architects pursuant to the Alabama Sunset Law, with modification. The act amends Section 34-17-7, Code of Alabama 1975, to revise the penalty for unlicensed practice as a landscape architect.

Act 1999-92, HB150, continues the existence and functioning of the State Board of Occupational Therapy pursuant to the Alabama Sunset Law, with modification. The act amends Section 34-39-3, Code of Alabama 1975, to provide for the referral and reevaluation of certain occupational therapy services by a licensed chiropractor.

Act 1999-93, HB146, continues the existence and functioning of the Board of Bar Examiners pursuant to the Alabama Sunset Law.

Act 1999-102, HB147, continues the existence and functioning of the State Board of Licensure for Professional Engineers and Land Surveyors pursuant to the Alabama Sunset Law, with modification. The act amends Sections 34-11-12, 34-11-15, and 34-11-36, Code of Alabama 1975, to authorize the board to reissue the license of a person whose civil rights are restored after conviction of a felony, to clarify the punishment of certain prohibited acts as provided by law, and to provide for the reversion of certain funds of the board to the State General Fund in the event the board elects to implement a biennial license cycle.

Act 1999-103, HB70, amends Sections 34-24-70 and 34-24-73, Code of Alabama 1975, relating to the Board of Medical Examiners, to provide further for the requirements for the issuance of a certificate of qualification for a license to practice medicine and reciprocal agreements for licensure by endorsement. The act authorizes the board to withhold approval of non-accredited colleges or schools of medicine under certain conditions and imposes additional postgraduate or residency training requirements upon those applicants for a certificate of qualification who have graduated from a college of medicine or osteopathy not accredited by the Liaison Committee on Medical Education or the American Osteopathic Association, respectively. The act authorizes the board to accept a passing score on the National Board of Osteopathic Medical Examiners Examination for applicants for initial licensure and for licensure by endorsement on or after January 1, 2000. The act provides for the withdrawal of an application for a certificate of qualification and for the withdrawal of a certificate of qualification and for the filing of a new application with the board. The act also provides for acceptance by the Board of Medical Examiners of the National Board of Osteopathic Medical Examiners Examination and the Licensing Medical Council of Canada Examination for applicants for a certificate of qualification by endorsement.

Act 1999-159, HB151, continues the existence and functioning of the Board for the Registration of Architects pursuant to the Alabama Sunset Law, with modification. The act amends Sections 34-2-33 and 34-2-36, Code of Alabama 1975, to authorize the board to contract with an independent testing agency, to require applicants to pay the actual cost of examination to that testing agency, to require uniform application, examination, and renewal fees, regardless of residency, and to revise the penalty for unlicensed practice as an architect.

Act 1999-191, HB127, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Bullock County, to prohibit the participation of certain elected or appointed county officials in the supernumerary program and provide for the elimination of that supernumerary program.

Act 1999-192, HB128, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Macon County, to prohibit the participation of certain elected or appointed county officials in the supernumerary program and provide for the elimination of that supernumerary program.

Act 1999-193, HB434, is Rose's Law. The act amends Section 27-48-2, Code of Alabama 1975, relating to health benefit plans, to require every plan that provides maternity coverage to provide coverage for postpartum care for a mother and her newborn. The act requires coverage of a minimum 48-hour postpartum hospital stay for a normal delivery and a minimum 96-hour postpartum hospital stay for a cesarean section delivery, unless the mother consents in writing to an informed early discharge.

Act 1999-194, SB84, proposes an amendment to the Constitution of Alabama of 1901, to provide for the elimination of existing supernumerary programs or systems and to provide for the participation of public officials in the Employees' Retirement System.

Act 1999-196, HB377, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Chambers County, to authorize the levy and collection of an additional countywide ad valorem tax of seven mills and an additional countywide sales and use tax of one-quarter of one percent (.25%), and to authorize an additional $10 fee for the issuance of motor vehicle license plates and decals. The proposed amendment provides that funds received from the additional taxes and fee be used for the repayment of existing county debt, for general county purposes, and to fund the Industrial Development Authority of Chambers County.

Act 1999-197, HB452, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Baldwin County, to establish the Baldwin County Judicial Commission and provide for the filling of vacancies in circuit court and district court judgeships.

Act 1999-198, HB299, amends Sections 41-10-541, 41-10-546, 41-10-547, 41-10-550, and 41-10-551, Code of Alabama 1975, relating to the Alabama Incentives Financing Authority, to authorize the authority to incur obligations to fund financial commitments made by the state after July 20, 1995, to industries committing to locate or expand in the state and to lease or convey title to any worker training facility to the Alabama Public School and College Authority or to the Alabama Industrial Development Training Institute. The act also authorizes the Alabama Incentives Financing Authority to issue bonds to fund expenses incurred in ensuring that state computer systems are Y2K compliant.

Act 1999-199, HB148, continues the existence and functioning of the State Licensing Board for General Contractors, with modification. The act amends Sections 34-8-2, 34-8-4, 34-8-6, 34-8-7, and 34-8-20, Code of Alabama 1975, to authorize the board to provide for a transitional license renewal period to implement a staggered license renewal schedule, to clarify the punishment of certain prohibited acts as provided by law, to exempt certain electric, natural gas, or telecommunications utilities from the operation of Chapter 8 of Title 34, and to authorize the Governor to remove any member of the board at any time, with or without cause.

Act 1999-203, SB251, adopts and incorporates into the Code of Alabama 1975, those general and permanent laws of the state enacted during the 1997 First Special Session and the 1998 Regular Session of the Legislature as contained in the 1998 Cumulative Supplement to certain volumes of the Code and in the 1998 Replacement Volumes 16, 16A, 17, and 21 of the Code. The act makes corrections in Volumes 11, 17A, and 18 of the 1998 Cumulative Supplement, and makes corrections to Sections 12-15-102, 32-9A-1, and 33-4-48, Code of Alabama 1975.

Act 1999-247, SB9, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Hale County, to authorize the county commission by resolution to impose an additional fee of up to and including $50 on all civil and criminal cases, excluding small claims cases, with the proceeds to be used for planning, designing, constructing, financing, furnishing, equipping, and operating a new county jail and for general county purposes.

Act 1999-248, SB476, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Jackson County, to prohibit the participation of certain elected or appointed county officials in the supernumerary program and provide for the elimination of that supernumerary program.

Act 1999-249, SB305, amends Section 6-3-7, Code of Alabama 1975, relating to venue of civil actions against corporations and transfer of venue. The act provides that a civil lawsuit against a foreign or domestic corporation may be brought in the county in which the occurrence took place, in the county where the foreign or domestic corporation's principal office in the state is located, or in the county in which the plaintiff resided at the time of the accrual of the cause of action so long as the corporation does business in that county by agent. The act also repeals Section 6-3-5, Code of Alabama 1975.

Act 1999-250, SB72, relates to class action civil lawsuits and the classification of classes of litigants. The act governs all class actions and supersedes any inconsistent provisions in Rule 23, Alabama Rules of Civil Procedure. The act requires a court to comply with certain procedures before certifying a class of civil litigants, requires a court order that either certifies or refrains from certifying a class to contain certain items, and provides that such an order is subject to an immediate appeal.

Act 1999-251, HB570, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Lauderdale County, to prohibit the participation of certain elected or appointed county officials in the supernumerary program and provide for the elimination of that supernumerary program.

Act 1999-252, HB723, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Autauga County, to impose an additional fee of $40 on all civil and criminal cases, excluding small claims cases, and a fee not to exceed $5 for the service of pleadings and other documents in connection with each such case, with the proceeds to be used for planning, designing, constructing, financing, and operating a new county jail and for planning, designing, repairing, renovating, financing, and operating the existing courthouse.

Act 1999-253, HB659, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Marion County, to provide for the establishment of the Marion County Agriculture and Exhibit Center Authority, provide for the appointment of the members of the authority, and provide for the powers and duties of the authority.

Act 1999-258, SB376, creates the Office of School Readiness as a department of the executive branch. The act provides that the office is responsible for administering programs and services as necessary for the operation and management of a voluntary pre-kindergarten program, provides for the employment of a director and other personnel to administer the pre-kindergarten program, and provides for the operation of the office.
EFFECTIVE DATE: 5/26/99, operative only upon ratification of the constitutional amendment proposed by Act 1999-8, 1999 Regular Session.
Act 1999-259, SB385, creates the Office of Information Technology as a department of the executive branch. The act provides that the office is responsible for administering programs and services as necessary for the operation and management of a program providing technology in public schools and public institutions of higher education, provides for the employment of a director and other personnel to administer the program, and provides for the operation of the office.

Act 1999-302, HB483, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Marion County, to prohibit the participation of certain elected or appointed county officials in the supernumerary program and provide for the elimination of that supernumerary program.

Act 1999-303, HB712, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Etowah County, to authorize any city or municipality within the county to impose and collect a business license tax on persons engaged in the business of buying, selling, or renting real estate.

Act 1999-304, SB374, is the "Alabama Education Lottery Act." The act provides for the operation of the Alabama Education Lottery Corporation and procedures for the distribution of lottery proceeds. The act provides for the powers and appointment of a board of directors, chief executive officer, and staff; the qualification and selection of vendors; a network of retailers and the Lottery Retailer Advisory Board; the applicability of state income tax, attachments, garnishments, or executions; the payment of prizes; applicability of laws relating to open meetings, inspection of public documents, and competitive bidding; and the definition of certain offenses, and criminal investigations. The act creates the Alabama Education Lottery Corporation Legislative Oversight Committee and provides penalties for violations.
EFFECTIVE DATE: 6/1/99, operative only upon ratification of the constitutional amendment proposed by Act 1999-8, 1999 Regular Session.
Act 1999-305, SB379, creates the Alabama Helping Outstanding Pupils Educationally, HOPE, Scholarship Program and office as a department of the executive branch. The act makes the office responsible for administering programs and services as necessary for the operation and management of the HOPE Scholarship Program and provides for the employment of a director and other personnel as necessary to administer the program.
EFFECTIVE DATE: 6/1/99, operative only upon ratification of the constitutional amendment proposed by Act 1999-8, 1999 Regular Session.
Act 1999-313, HB57, amends Section 1-2-11, Code of Alabama 1975, relating to the state flower, to specify that the species of camellia designated as the official state flower of Alabama is the Camellia japonica L., and to designate the oak-leaf hydrangea as the official state wildflower.

Act 1999-314, HB383, amends Section 40-18-160, Code of Alabama 1975, relating to state income tax and Alabama S corporations, to clarify that the definition of an "Alabama S corporation" conforms to the federal income tax definition and includes a subchapter S corporation wholly-owned by a tax-exempt shareholder such as an employee stock ownership trust. The act also conforms the section to the federal rule by providing for the disregarded entity status of "qualified subchapter S subsidiaries" and provide separate retroactive effective dates.
EFFECTIVE DATE: 12/31/98, except that provision clarifying the definition of an Alabama S corporation is effective retroactive to 12/31/1997.
Act 1999-319, HB64, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Chilton County, to prohibit the participation of certain elected or appointed county officials in the supernumerary program and provide for the elimination of that supernumerary program.

Act 1999-320, HB725, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Clay County, to prohibit the participation of certain elected or appointed county officials in the supernumerary program and provide for the elimination of that supernumerary program.

Act 1999-321, HB13, proposes an amendment to the Constitution of Alabama of 1901, to repeal Section 102 of the Constitution of Alabama of 1901, and abolish the prohibition against interracial marriages.

Act 1999-345, HB152, continues the existence and functioning of the Alabama Board of Cosmetology pursuant to the Alabama Sunset Law, with certain modification. The act repeals Chapter 7 (commencing with Section 34-7-1), Title 34, Code of Alabama 1975, the existing law relating to the board, and adds a new Chapter 7A to Title 34, Code of Alabama 1975, to provide for the Alabama Board of Cosmetology and the regulation of cosmetologists. The act provides for the transition of the current board into the newly constituted board, the appointment of an executive director by the Governor, the hiring of employees, the powers and duties of the board, and the regulation, teaching, licensing, and practice of cosmetologists, manicurists, and estheticians. The act authorizes the board to establish fees and adopt rules and regulations pursuant to the Administrative Procedure Act. The act requires continuing education of licensees provides penalties for violations.

Act 1999-347, HB91, repeals Article 2, composed of Sections 29-1-40 to 29-1-44, inclusive, Chapter 1, Title 29, Code of Alabama 1975, relating to the Alabama Legislative Compensation Commission. The article provided that unless the recommendations of the commission were adopted by a majority vote of both houses of the Legislature during the third regular session of the quadrennium, the compensation of the Legislature for the next quadrennium was to remain in the same amount.

Act 1999-348, SB451, authorizes the Alabama Public School and College Authority to sell and issue $89,000,000 of additional bonds to provide funds for worker training facilities and Y2K preparation. The act provides funds for the acquisition, construction, reconstruction, alteration, and improvement of the Madison Training Facilities and the education and training of workers at that facility. The act provides funds to acquire the Tuscaloosa Training Facility from the Alabama Incentives Financing Authority and to prepay an obligation of that authority. The act provides funds to Troy State University to be used for the construction of a training facility for Lockheed Martin Marietta in Pike County. The act provides funds to assure that the state computer systems responsible for the collection and disbursement of education funds are Y2K compliant.

Act 1999-349, HB477, amends Section 41-9-201, Code of Alabama 1975, relating to the Alabama Development Office, to increase the compensation of the director and provide for the employment of five assistant directors outside of the State Merit System.

Act 1999-350, HB715, amends Sections 11-92A-1, 11-92A-3 to 11-92A-6, inclusive, 11-92A-9 to 11-92A-12, inclusive, 11-92A-14 to 11-92A-16, inclusive, 11-92A-18, and 11-92A-22, Code of Alabama 1975, relating to county industrial development authorities, to provide for the operation of an authority in more than one county. The act provides for the incorporation, name, appointment of officers and directors, reincorporation, amendment of articles, powers, and dissolution of an industrial development authority. The act also provides for the issuance of and security for bonds and exemptions from taxation.

Act 1999-351, HB527, relates to the Alabama Development Office. The act requires any entity that is considering locating or expanding a facility within the state and intends to claim certain incentives provided by the state to notify the Director of the Alabama Development Office. The act includes all of the following incentives: (1) Capital investment credits pursuant to Act 95-187, (2) a site preparation grant pursuant to Act 91-635, (3) funding for access roads and bridges pursuant to Act 85-549, the Alabama Industrial Access Road and Bridge Corporation, (4) training or other assistance from the Alabama Industrial Development Training Program where the annual expenditure of cash is estimated to be in excess of $1,000,000, and (5) any direct or indirect cash payment for a project from the state, whether in the form of an in-kind contribution of a site, building, equipment, or otherwise.

Act 1999-352, HB188, makes supplemental appropriations of $1,480,000 to the Department of Youth Services, $4,720,00 to the Department of Public Health, $4,400,000 to the Department of Mental Health and Mental Retardation, $700,000 to the Department of Public Safety, $100,000 to the Legislative Reference Service, $40,000 to the Court of Criminal Appeals, $785,000 to the Administrative Office of Courts, $80,000 to the Governor's Office on Disability, $250,000 to the Department of Corrections, and $300,000 to the Legislature from the State General Fund for the fiscal year ending September 30, 1999. Makes a supplemental appropriation of $743,727 to the Department of Veterans' Affairs from the Veterans' Assistance Fund for the fiscal year ending September 30, 1999. Makes a supplemental appropriation of $200,000 to the Farmers Market Authority from the Farmers Market Authority Fund for the fiscal year ending September 30, 1999. Makes a supplemental appropriation of $245,000 to the Alabama Surface Mining Commission from the Alabama Surface Mining Fund for the fiscal year ending September 30, 1999. Makes a supplemental appropriation of $225,000 to the State Health Planning Agency from departmental receipts for the fiscal year ending September 30, 1999. Makes a supplemental appropriation to the Administrative Office of Courts from the Juvenile Probation Services Fund of those sums received from counties to pay the salaries and fringe benefits of juvenile probation officers pursuant to Act 98-392. Makes conditional appropriations of $1,000,000 to the Department of Veterans' Affairs for Veterans Nursing Homes and $750,000 to the Department of Finance from the State General Fund. Makes a supplemental appropriation of $100,000 to the Department of Forensic Sciences from the Forensic Services Fund and $300,000 from the DNA Fund for the fiscal year ending September 30, 1999.

Act 1999-353, HB323, is the "Alabama 21st Century Fund Act." The act creates the Alabama 21st Century Fund into which tobacco revenues will be deposited. The act authorizes the incorporation of the Alabama 21st Century Authority to issue bonds and provides for the distribution of revenues remaining in the Alabama 21st Century Fund after providing for the payment of principal, interest, and premiums on bonds issued by the authority. The act provides for the transfer of funds to the Children First Trust Fund, the Senior Services Trust Fund, and the State General Fund for appropriation to the Alabama Medicaid Agency, including the Medicaid Waiver Program at the Alabama Commission on the Aging.

Act 1999-355, HB511, amends Sections 24-6-2, 24-6-3, and 24-6-4, Code of Alabama 1975, relating to the Alabama Manufactured Housing Commission, to restructure the commission, provide for the duties and responsibilities of the commission, provide for appointments, meetings, terms, qualifications, and vacancies, provide for an administrator for the duties and responsibilities of the administrator.

Act 1999-358, SB137, amends Section 6-11-21, Code of Alabama 1975, relating to the award of punitive damages, to establish limitations on the award of punitive damages in civil actions where punitive damages are permitted by law. The act provides that, unless otherwise provided, in civil actions punitive damages may not exceed three times the compensatory damages of the party claiming punitive damages or $500,000, whichever is greater. In civil actions against a small business defendant with a net worth of $2,000,000 or less at the time of the occurrence made the basis of the suit, punitive damages may not exceed $50,000 or 10 percent of the business' net worth, whichever is greater. In civil actions for physical injury, punitive damages may not exceed three times the compensatory damages of the party claiming punitive damages or $1,500,000, whichever is greater. The act requires that the limitations on punitive damages be adjusted at three year intervals. The act excludes class actions, actions for wrongful death, and actions for intentional infliction of physical injury.
EFFECTIVE DATE: 6/7/99, applicable to actions commenced more than 60 days after the effective date.
Act 1999-361, HB402, is the "Alabama Child Protection Act of 1999." The act establishes a procedure for conducting criminal background checks on applicants and current employees who work unsupervised with children in an educational setting. The act provides procedures for initiating, requesting, and receiving criminal history background information. The act applies to the State Department of Education, local boards of education, the Alabama Institute for Deaf and Blind, the Alabama School of Fine Arts, the Department of Youth Services School District, the Alabama School of Mathematics and Science, two-year institutions under the State Board of Education, state four-year institutions, and certain nonpublic schools, excluding parents engaged in home schooling. The act provides for fees, confidentiality, fingerprinting training, the promulgation of rules and regulations by the State Department of Education and the Department of Public Safety, and liability.

Act 1999-362, HB84, amends Section 36-7-22, Code of Alabama 1975, relating to reimbursement for travel on official state business in privately owned motor vehicles, to provide for reimbursement based upon the mileage rate allowed by the Internal Revenue Code and to require reimbursement within 30 days after request.

Act 1999-363, HB526, is the "Sychronized Taxation and Registration System" or "STARS" Act. The act amends Section 40-12-253, Code of Alabama 1975, relating to the ad valorem taxation of motor vehicles, to synchronize the collection of ad valorem taxes with motor vehicle registration fees on a current year basis and further for the assessment and collection of ad valorem taxes on motor vehicles.

Act 1999-365, SB333, amends Section 41-23-22, Code of Alabama 1975, relating to enterprise zones, to establish an enterprise zone in Tallapoosa County and every incorporated municipality in Tallapoosa County.

Act 1999-367, SB3, amends Section 40-18-74, Code of Alabama 1975, relating to the payment of withholding taxes, to return the date of filing and reporting quarterly withholding tax to the last day of the month following the end of a quarter.

Act 1999-368, SB127, amends Section 40-7-2.1, Code of Alabama 1975, relating to the 1983 Taxpayer Convenience Act, to permit an attorney to apply to the county tax assessor for a homestead exemption on behalf of the person claiming the exemption.

The act applies to any failure or malfunction occurring before December 31, 2005.

Act 1999-372, SB351, relates to the Department of Public Health. The act requires the department to establish a comprehensive cardiac arrest survival plan for the training and certification of primary cardiac care providers in the use of semiautomatic external defibrillators. The act makes a conditional appropriation of $3,000,000 from the State General Fund to the Alabama State Fire College-Shelton Community College to assist in the purchase of semiautomatic external defibrillators and training of emergency medical care providers. The act also creates the Cardiac Arrest Survival Commission.

3Act 1999-378, HB40, amends Section 36-27-52, Code of Alabama 1975, relating to the participation of official court reporters in the Employees' Retirement System in lieu of becoming a supernumerary court reporter. The act permits any official court reporter employed prior to August 13, 1987, who elected to remain in the supernumerary program, had a lapse in service, and subsequently earned creditable years of service in the Employees' Retirement System, to have those creditable years of service transferred to the court reporter's supernumerary program.

Act 1999-381, HB220, amends Section 41-4-60, Code of Alabama 1975, relating to the disposition of outstanding and unpaid state warrants, to provide for the transfer of the amount of any voided warrants to the Unclaimed Property Fund. The act adds a new Section 35-12-51, to the Code of Alabama 1975, relating to the reporting of voided state warrants, to provide for the reporting and maintenance of voided warrants through the Unclaimed Property Division of the State Treasurer's Office and for the recovery of amounts transferred to the State General Fund on warrants dated after August 30, 1995.

Act 1999-382, HB287, relates to payroll deductions for employees of public boards of education, two-year institutions of postsecondary education, and retirees under the Teachers' Retirement System. The act requires the Teachers' Retirement System, boards of education, and institutions of postsecondary education to establish a separate payroll deduction slot for those employees who purchase group plans for annuities, deferred compensation, disability, casualty, automobile, personal liability, long-term health care, and health insurance, and other programs offered on a statewide basis through the professional organization representing the majority of employees.

Act 1999-383, HB89, amends Section 11-91-8, Code of Alabama 1975, relating to the provision of health or medical insurance for retired employees of counties and municipalities, to authorize the governing body of a public agency that participates in the Employees' Retirement System or the local government health insurance program of the State Employees' Insurance Board to elect to allow the retired employees of the agency to participate in certain health, hospitalization, surgical, or medical insurance programs.

Act 1999-388, HB79, amends Sections 17-10-3, 17-10-5, and 17-10-7, Code of Alabama 1975, relating to absentee voting. The act provides for on-site absentee voting on the Saturday 10 days before the election at courthouses, courthouse annexes, and other locations as determined by the appropriate governing body. The act requires an absentee voter to provide his or her signature, residence address, and date of birth on the poll list prior to voting. The act provides for the duties of the absentee election manager and other on-site absentee polling officials, the notification of prospective voters, and the application of the absentee voting law to military personnel and their families pursuant to federal law. The act also provides for the mailing of absentee ballots by the absentee election manager.

The act provides for the transfer of tobacco revenues into the fund for the 2000 fiscal year, and each fiscal year thereafter, removes the Juvenile Justice Coordinating Council as the entity providing allocations to programs, and establishes the duties of the Commissioner of Children's Affairs relating to the fund. The act specifies the authority of the Governor and the Attorney General pertaining to the institution of, intervention in, or settlement of litigation on behalf of the state, the appointment and compensation of attorneys representing the state, and the authority of the Attorney General in connection with any criminal investigation conducted by the Office of the Attorney General. The act provides funding for children's services provided by the Department of Public Health, the State Board of Education, the Alabama Department of Human Resources, the Children's Trust Fund, the State Multiple Needs Children's Fund, the Department of Mental Health and Mental Retardation, the Juvenile Probation Services Fund through the Administrative Office of Courts, the Department of Youth Services, the Alabama Medicaid Agency, the Alcoholic Beverage Control Board, the Department of Forensic Sciences, and the Department of Rehabilitation Services. The act requires funding for the Children First Trust Fund programs for the fiscal year ending September 30, 2000, and each fiscal year thereafter, to be by a separate appropriation act.

Act 1999-391, HB716, is the "Job Development Act of 1999." The act authorizes the Alabama 21st Century Authority, created pursuant to Act 99-353, to sell and issue bonds not exceeding $50,000,000, in aggregate principal amount, to fund commitments made by the state to induce an internationally renowned company to locate a state-of-the-art manufacturing facility in the state. The act prescribes additional powers and duties of the authority and provides that the bonds issued will be payable out of tobacco revenues held in the Alabama 21st Century Fund.

Act 1999-392, HB743, proposes an amendment to the Constitution of Alabama of 1901, pertaining only to Randolph County, to permit the judge of probate to serve as the nonvoting chair of the county commission. The amendment also authorizes the Legislature, by local law, to alter, modify, and reallocate the functions, duties, operations, and responsibilities of county officials.

Act 1999-393, HB153, proposes an amendment to the Constitution of Alabama of 1901, to provide that the counties and incorporated municipalities in the state receive at least 10 percent of the trust income from the Alabama Trust Fund when the preceding fiscal year trust income exceeds $60,000,000. The proposed amendment authorizes the Legislature to appropriate more than 10 percent of the trust income to the counties and incorporated municipalities and requires that the distributed funds are expended as provided by general law.

Act 1999-395, SB85, relates to the Master Settlement Agreement entered into by the state and certain leading United States tobacco product manufacturers on November 23, 1998. The act requires any tobacco product manufacturer that sells cigarettes to consumers within the state and is not a part of the agreement to pay its allocable share into an escrow fund for use by the state.

Act 1999-396, SB92, amends Section 9-17-33, Code of Alabama 1975, relating to conservation and regulation of oil and gas production, to provide for the disposition of proceeds from the sale of oil and gas production to the royalty owner or working interest owner, to limit the amount of accumulation during the year before payment, to provide for at least annual payment, and to provide that owners may be paid more frequently upon request.

Act 1999-397, HB7, amends and repeals Section 32-5B-6, Code of Alabama 1975, relating to the issuance of citations for the violation of the mandatory safety belt law. The act amends the section for six months to provide for the issuance of a warning citation in those instances where a motor vehicle is stopped for the seat belt violation and there is no separate violation of law. Effective six months after the effective date of the act, the act allows issuance of a ticket for a seat belt violation without any other violation and exempts a person fined for violating the safety belt law from the assessment of court costs. The act also limits searches by a law enforcement officer and requires state, county, and municipal police departments to maintain statistical information on minority members stopped and report that information monthly to the Department of Public Safety and the Attorney General.

The act clarifies that property classified as utility property does not include customer-owned coin-operated telephone companies. The act clarifies that cellular telecommunication services include broadband personal communication services and commercial mobile radio services as provided by federal law. The act adds Sections 40-21-88 and 40-21-125, Code of Alabama 1975, to provide a good faith reliance exception for certain retailers and providers who rely upon state tax exemption numbers.

The act authorizes the board to issue a special purpose license for the practice of dentistry across state lines, increases fees, and imposes new fees on applicants for examination and licensure as dentists or dental hygienists. The act provides for the terms, conditions, and renewal of licenses, exemptions from licensure, reciprocity, and imposes penalties for violations.

Act 1999-409, SB37, amends Sections 40-26B-21 and 40-26B-26, Code of Alabama 1975, relating to the privilege tax on medical services providers. The act removes the termination date of December 31, 1999, pertaining to the supplemental privilege tax on the business activities of nursing facilities and certain Medicaid program nursing facility requirements. The act abolishes the task force created to study Alabama Medicaid nursing home reimbursement and authorizes the Commissioner of the Alabama Medicaid Agency to pay enhancements to certain rural hospital connected nursing facilities.

Best of A minus or better instead of A or better.

The act amends Sections 12-19-71, 12-19-72, 12-19-171 to 12-19-176, inclusive, 12-19-178, 12-19-179, 12-19-250, 12-19-251, 15-12-21 to 15-12-23, inclusive, Code of Alabama 1975, relating to docket fees, the fair trial tax, and fees for attorneys representing indigent criminal defendants. The act increases docket fees, increases the fair trial tax, and provides for an additional assessment upon the conviction or adjudication of a defendant in municipal, juvenile, district, or circuit court. The act provides for the distribution of fees in the Fair Trial Tax Fund, the Advanced Technology and Data Exchange Fund, and the State General Fund. The act increases the hourly compensation and maximum compensation of attorneys providing indigent defense, permits courts to exceed those limits, for good cause shown, and provides funding for the statewide coordination of pro bono legal services and the furtherance of attorney professionalism. The act creates the Advanced Technology and Data Exchange Fund to expand and enhance the capabilities of courts through increased technology. The act establishes a uniform compensation plan for state trial and appellate judges, phasing out existing county salary supplements and expense allowances. The act also repeals Sections 12-19-250.1 and 40-1-38, Code of Alabama 1975.

The act increases the number of elected Senate members to six; adds the majority and minority leaders of the Senate and House as members; provides for designees of the majority and minority leaders to serve in their place for a one-year term; provides that certain Senate and House members may designate another member to serve in their place for a one-year term; and provides for two additional members in certain instances.

The act requires proof of a motor vehicle liability insurance policy as a condition of registration and licensing of a motor vehicle. The act requires a driver to present proof of insurance when presenting a driver's license to a law enforcement officer. The act provides fines and criminal penalties for violations.

The act provides for the inspection of records by the victim or his or her representative. The act specifies which acts of delinquency are subject to report to the Alabama Criminal Justice Information Center. The act provides for the fingerprinting, photographing, and taking of blood or other samples of a child charged with an act of delinquency. The act requires written notice to the appropriate school officials concerning any juvenile adjudicated delinquent for certain felonies and authorizes the court to provide notice for other delinquent acts.

The act provides that consent or relinquishment may be implied for adoption purposes if the father, with reasonable knowledge of the pregnancy, fails to offer financial or emotional support for six months before the birth. The act also provides for the reimbursement of the petitioner of certain medical and living expenses of the child where an adoption is denied after a contested case hearing and for legal costs associated with a contested case hearing where the contest fails.

Act 1999-436, HB25, relates to grandparent visitation. The act permits a grandparent to intervene in an existing action or file an original action for visitation with a minor grandchild if one or both parents are deceased, the marriage of the parents is dissolved, the child has been abandoned, the child was born out of wedlock, or if either or both parents prohibit a relationship between the child and the grandparent. The act requires a court to order visitation if it is in the best interests of the child. The act also repeals Section 30-3-4, Code of Alabama 1975.

The act provides for priority, notice to persons outside of the state, appearance, limited immunity, and cooperation between courts. The act provides for jurisdiction, enforcement, registration of child custody determination, simultaneous proceedings, and expedited enforcement of a child custody determination. The act applies only to proceedings commenced after 12/31/99. The act also amends Section 30-3-156, Code of Alabama 1975, and repeals Article 2, Chapter 3, Title 30 (Sections 30-3-20 to 30-3-44, inclusive), Code of Alabama 1975.

The act provides for the use of bond forfeiture proceeds on other lands affected by strip mining.

The act provides for the submission of grant applications, the distribution of funds, and the flexibility of boards of education in the spending those funds. The act increases the potential maximum for Buskey Matching funds from $100,000 to $2,000,000 from both the Education Trust Fund and State General Fund budgets.

Act 1999-593, HB674, amends Section 9-16-91, Code of Alabama 1975, relating to surface effects of underground coal mining, to provide for the prompt correction of material damage resulting from subsidence caused to surface lands, to the extent technologically and economically feasible, by restoring the land to a condition capable of maintaining the value and reasonably foreseeable uses that it was capable of supporting before subsidence. The act also specifies that the remedies provided in the section, or any rule promulgated under Chapter 16 of Title 9, Code of Alabama 1975, pertaining to repair or compensation for subsidence damage and replacement of water, are the sole and exclusive remedies available to the owner for the damage and its effects.

The act requires the Alabama Historical Commission to manage and preserve certain underwater artifacts, treasure troves, or other cultural resources. The act, construed together with Section 41-9-249.1, Code of Alabama 1975, prohibits the taking or damaging of cultural resources without a contract or permit issued by the commission.

Act 1999-597, HB387, relates to scrap tire disposal. The act requires that all scrap tire handlers obtain an annual license, dispose of scrap tires according to the act, and maintain records regarding the receipt and disposal of scrap tires. The act exempts governmental entities, innocent landowners, and individuals from license requirements but requires each to comply with scrap tire receipt and disposal requirements. The act provides penalties for violation. The act creates a Scrap Tire Study Commission to develop plans for the environmentally safe removal of existing scrap tire piles located in Alabama.

Act 1999-598, HB480, amends Sections 32-5A-301 to 32-5A-308, inclusive, Code of Alabama 1975, relating to the suspension of driving privileges for alcohol related offenses. The act requires an arresting law enforcement officer to deliver a sworn arrest report to the Department of Public Safety within five days after the date of arrest and requires the department to take no action and return the driver's license of an arrested person if a report is not properly prepared or received. The act requires the department to provide notice of suspension or notice of intended suspension to an alleged violator and to rescind a suspension order and remove the administrative suspension from a person's driving record when certain related criminal charges have been dismissed. The act also provides for the timing of a request for administrative review and provides for administrative hearings before the director of the department.

Act 1999-599, HB106, amends Section 14-1-1.2, Code of Alabama 1975, relating to the Department of Corrections, to require the consent of the Legislature before a penal or corrections institution is leased, transferred, or placed under the management of a nongovernmental entity.
