Under existing law, no person shall give a thing of value to a member of a governmental agency, board, or commission that regulates a business with which the person is associated.This bill would prohibit the Commissioner of the Department of Agriculture and Industries or a candidate for the office of commissioner from accepting campaign contributions from persons associated with businesses regulated by the department.

TO BE ENTITLED
AN ACT

To amend Section 36-25-12, Code of Alabama 1975, relating to the prohibition against offering members of regulatory boards a thing of value, to prohibit the Commissioner of the Department of Agriculture and Industries or a candidate for the office of commissioner from accepting campaign contributions from persons associated with businesses regulated by the department.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. Section 36-25-12, Code of Alabama 1975, is amended to read as follows:

36-25-12.

"No person shall offer or give to a member or employee of a governmental agency, board, or commission that regulates a business with which the person is associated, and no member or employee of a regulatory body, shall solicit or accept a thing of value while the member or employee is associated with the regulatory body other than in the ordinary course of business. In addition to the foregoing, the Commissioner of the Department of Agriculture and Industries and any candidate for the office of commissioner may not accept a campaign contribution from a person associated with a business regulated by the department."

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
