Relating to Blount County; proposing an amendment to the Constitution of Alabama of 1901, to prohibit any municipality that is not wholly or in part within the boundaries of Blount County on the effective date of this amendment from annexing any territory within Blount County without the approval of the electorate of Blount County expressed in a vote on the issue of the annexation.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. The following amendment to the Constitution of Alabama of 1901, is proposed and shall become valid as a part of the Constitution when all requirements of this act are fulfilled:PROPOSED AMENDMENT
Any municipality that is not located wholly or in part within the boundaries of Blount County on the effective date of this amendment may not annex any territory within Blount County without the approval of a majority vote of the qualified electors of Blount County voting at a referendum election on the issue of the annexation. The provisions of this amendment shall not apply to any municipality incorporated after the ratification of the amendment that lies entirely within the boundaries of Blount County. This amendment does not apply to any territory annexed within Blount County by a municipality prior to the effective date of this amendment. Notwithstanding the other provisions of this amendment, territory in Blount County in the subdivision of Woodhaven may be annexed as otherwise provided by law by the City of Pinson without a referendum and any territory contiguous to the City of Pinson as a result of any annexation in the subdivision of Woodhaven may be annexed to the City of Pinson by local legislative act without a referendum. The Legislature may pass local or general acts to supplement this amendment provided the acts do not contravene this amendment.
Section 2. An election upon the proposed amendment shall be held in accordance with Amendment 555 to the Constitution of Alabama of 1901, now appearing as Section 284.01 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.
Section 3. The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:
"Relating to Blount County, proposing an amendment to the Constitution of Alabama of 1901, to prohibit any municipality that is not located wholly or in part within the boundaries of Blount County on the effective date of this amendment from annexing any territory within Blount County without the approval of the electorate of Blount County expressed in a vote on the issue of the annexation.
"Proposed by Act _________."
This description shall be followed by the following language:
"Yes ( ) No ( )."
