ENROLLED, An Act,

Amending Amendment 591 to the Constitution of Alabama of 1901, now appearing as Section 11, Local Amendments, City of Tuskegee, Official Recompilation of the Constitution of Alabama of 1901, as amended, relating to the election of two persons to the utilities board of the City of Tuskegee in Macon County; to provide for the election to be conducted by the utilities board and the term of office of, procedure for the filling of vacancies in, and compensation of, the positions; and to provide for who may vote in the election.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. The following amendment to the Constitution of Alabama of 1901, as amended, is proposed and shall become valid as a part thereof when approved by a majority of the qualified electors voting thereon and in accordance with Sections 284, 285, and 287 of the Constitution of Alabama of 1901, as amended:

PROPOSED AMENDMENT

Amendment 591 to the Constitution of Alabama of 1901, now appearing as Official Recompilation of the Constitution of Alabama of 1901, Local Amendments, City of Tuskegee, Section 11 (Amendment 591), as amended, is amended to read as follows:

"AMENDMENT 591.

"Two persons shall be elected to the electrical utility owned by utilities board of the City of Tuskegee at the same time that the mayor and city council. Commencing with the next term of office, the elections are shall be held and conducted by the utilities board. The the elected candidates for members of the electrical utility shall qualify for office in the same manner. The election shall be conducted in the same manner as that for the election for city council. In the interim of the time between the adoption of this amendment and the mayor-city council election, the State Senator and the Alabama House Representative representing the City of Tuskegee shall each appoint a member on the electrical utility board owned by the City of Tuskegee to serve, only during the interim period until the election. utilities board shall be elected to a term of four years, at the same time as regular municipal elections for Macon County, Alabama. A person eligible to vote in the election shall be a registered voter in Macon County who receives services from the utilities board. "Receives services" means that the person is a resident of a building that receives electricity, sewage, or water services, or any combination thereof, from the utilities board. When a vacancy occurs in either of the two elected positions, the board shall fill the vacancy for the unexpired term of office. The members of the utilities board of directors of the electrical utility who are not members of the city council shall each receive fifty dollars ($50) per meeting, not to exceed one hundred dollars ($100) per month the City of Tuskegee shall set the compensation of the directors."

Section 2. An election upon the proposed amendment shall be held in accordance with Sections 284 and 285 of the Constitution of Alabama of 1901, now appearing as Sections 284 and 285 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.

Section 3. The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:

"Relating to the City of Tuskegee in Macon County, proposing an amendment to Amendment 591 to the Constitution of Alabama of 1901, to provide for the election of two persons to the utilities board and the term of office of, procedure for the filling of vacancies in, and compensation of, the positions; and to provide for who may vote in the election.

"Proposed by Act ________."

This description shall be followed by the following language:

"Yes ( ) No ( )."
