FISCAL NOTE

Senate Bill 226 (Act 2016-279) as enacted adds Mitragynine and Hydroxymitragynine, commonly known as Kratom and Vivazen, to the list of synthetic controlled substances on the Schedule I controlled substances list making these drugs unlawful and person convicted of possession, distribution and trafficking of these substances subject to existing criminal penalties. This act could increase receipts to the State General Fund and municipal general funds from fines; increase receipts to the State General Fund, county general funds, municipal general funds, and other funds to which court costs are deposited; and could increase the obligations of local jails, the district attorneys, the Department of Corrections, community corrections and the Board of Pardons and Paroles by an amount dependent upon the number of persons charged with and convicted of the offenses provided by this act and the penalties imposed.
